These Terms of Service (the “Terms”) govern your access to and use of the Cigars Valet website and your purchase of products through it. Cigars Valet is operated by Cigars Valet LLC (“we,” “us,” or “our”). By using the site or placing an order, you agree to these Terms. If you do not agree, do not use the site.
1. Eligibility & age requirement
You must be at least 21 years of age (or the minimum legal age for tobacco purchase in your jurisdiction, if higher) to view, purchase, or receive products from us. By using the site you represent and warrant that you meet this requirement. We sell tobacco products intended solely for adults of legal age; sales to or for minors are strictly prohibited. Age is acknowledged at checkout and verified again, with government-issued photo ID, at the time of delivery — see our Age Verification Policy.
2. Products & pricing
We make every effort to display products, descriptions, and prices accurately, but we do not warrant that all content is error-free, complete, or current. Prices and availability are subject to change without notice. Tobacco products are sold subject to applicable taxes and regulatory requirements. We reserve the right to limit quantities and to correct errors, including after an order is submitted.
3. Orders & acceptance
Your submission of an order is an offer to purchase. All orders are subject to our acceptance, and we may decline or cancel any order for any lawful reason — including suspected fraud, ineligibility, inability to verify age, unserviceable address, pricing or inventory errors, or quantity limits. A confirmation does not guarantee acceptance until the order is dispatched.
4. Payment
Payment is processed by our third-party payment provider (Stripe). We do not receive or store your full card details. For most orders we authorize your card at checkout and charge it when a courier accepts the delivery, so you are not charged for an order that cannot be fulfilled. You authorize us (through our provider) to charge your payment method for the order total, including taxes and delivery fees.
5. Delivery
We offer on-demand local delivery within our serviceable area through third-party courier services. Delivery times and fees are estimates shown at checkout. An adult of legal age must be present to receive the order and present valid ID. See our Delivery & Refund Policy for details.
6. Cancellations & refunds
Orders may be cancelled and refunded before the courier picks them up. Once an order has been picked up for delivery it generally cannot be cancelled or returned, except as required by law or described in our Delivery & Refund Policy.
7. Acceptable use
You agree not to:
- purchase products if you are under the legal age, or for resale or delivery to a minor;
- resell, redistribute, or re-ship products purchased from us;
- provide false information, including about your age or identity;
- use the site for any unlawful purpose or in violation of any applicable tobacco law; or
- interfere with, disrupt, or attempt to gain unauthorized access to the site or its systems.
8. Intellectual property
The site and its content — including text, graphics, logos, and design — are owned by us or our licensors and are protected by applicable laws. You may not copy, reproduce, or create derivative works without our prior written permission.
9. Disclaimers
The site and products are provided “as is” and “as available” to the fullest extent permitted by law. Tobacco products are dangerous to health; see the warnings in our Age Verification Policy. We disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose.
10. Limitation of liability
To the maximum extent permitted by law, Cigars Valet LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Cigars Valet LLC and its affiliates from any claims, damages, or expenses arising out of your breach of these Terms or your misuse of the site or products.
12. Governing law & disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and your continued use of the site constitutes acceptance of the updated Terms.
